Negotiation and Mediation Advocacy Breakfast Forum
 

Are you an attorney with solid experience in negotiation and mediation advocacy?  Would you like to take that experience to a whole new level, so you can:

Negotiation and Mediation Advocacy Breakfast Forum is a regular breakfast workshop for discussion, dialogue, and information/experience exchange with attorneys like you – attorneys who have depth in negotiation and mediation advocacy, and want to do everything they can to optimize outcomes.

Mediator/facilitator Paul Fisher will lead a dynamic discussion focused on the most current cases in negotiation and mediation advocacy, the issues you bring to the table.

Additional issues to be covered over time include:

  • How to deal with the difficult client and opposing counsel at the mediation.
  • Preparing effectively for mediation.
  • Briefs: are they beneficial? Worth the effort? Exchanged or confidential?
  • Maximizing the benefits of the mediator.
  • Joint session: To have or have not; when to avoid, and why.
  • Dealing with the really tough issues in mediation.
  • The mediator's role: Beyond basics to the exotic.
  • Documenting the settlement: From the basics through up to the moment critical; ie. what "magic words" are absolutely necessary to make the settlement agreement enforceable?
  • Enabling the mediator to make you look great in front of your client.

Estate Conflict Management Workshop
 

In a contested estate matter emotions can run incredibly high. Families leave the probate/estates litigation process exhausted and embittered. These feelings of client unhappiness may be exacerbated for some parties who are angry and resentful at their attorney who has charged significant fees. A contested estate matter is financially expensive, emotionally draining and the goals of the testator may have been frustrated in the process. Some family relationships may be destroyed. Perhaps there is a better way to provide estate planning clients more certainty about the future of their estates, and to provide families with peace and security for the future. Perhaps for clients in contested estate matters there are means to manage these conflicts in a less financially draining and emotionally destructive manner. When estate claims are resolved sooner, families will have spent fewer financial and emotional resources on the conflict. Managing estate conflict - both existing and potential conflicts - presents the possibility to deliver much more financial and emotional value to clients, provide higher client satisfaction, and higher personal and economic satisfaction to the practitioner.

This workshop focuses on early identification and management of conflict that could arise out of a testator's estate planning and which could lead to litigation. The workshop also explores and brainstorms means of managing conflict in estate litigation. It is an opportunity for participants to be at the genesis of a change in the culture of how conflicts are resolved in probate and estates litigation. This workshop is highly participatory.
